Terms of Service — Capsule Kaiju: Toy Tower

These Terms of Service (“Terms”) apply to your use of Capsule Kaiju: Toy Tower (“the App”). The App is published by AFnextgames, based in Ireland (“we”, “us”). By downloading or using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. Using the App

We give you a personal, non-exclusive, non-transferable licence to download and play the App on devices you own or control, for your own non-commercial entertainment, in line with these Terms and the Google Play Terms of Service.

You agree not to:

• copy, modify, reverse engineer, decompile or redistribute the App, except where the law allows it;
• cheat, use modified versions of the App, or tamper with its save data or purchases;
• interfere with the App’s advertising, or generate fake ad views or clicks;
• use the App for anything unlawful.

2. Coins, power-ups and other virtual items

The App contains virtual items, such as coins, power-ups, revives, boosts, pets and cosmetic looks. Some can be earned by playing and some can be bought.

• Virtual items have no real-world value. They cannot be exchanged for money, transferred or sold, and they can only be used inside the App.
• You get a licence to use virtual items in the App; you do not own them.
• Time-limited items (such as Level Rush or the Week Pass) run for the period described in the App, in real time, whether or not you are playing.
• We may change how virtual items work or are balanced, for example to fix a bug or improve the game. We will not take away a one-time purchase (such as Remove Ads, the Starter Pack look, Maneki Kaiju, the Golden Cabinet or the Baby Kaiju) unless it is refunded or reversed.

3. Purchases

• All purchases are made through Google Play and processed by Google under Google’s terms. We never see or store your payment details.
• Prices are shown in the App and on Google Play before you buy. Some offers have a lower price for a limited time, which is shown with a countdown.
• Remove Ads removes the ads shown between levels. Optional rewarded ads (for example, watching an ad for a revive or a power-up) stay available, because you choose to watch them.
• Because the App delivers digital content immediately, by buying you ask us to deliver it straight away and you acknowledge that you lose the right to withdraw from the purchase once it is delivered, as permitted by EU consumer law. This does not affect your statutory rights if the content is faulty.
• Refund requests are handled by Google Play under its refund policies. If a purchase is refunded or reversed, the items it granted may be removed.

4. Your progress is stored on your device

The App has no accounts and no servers of ours. Your progress (score, level, trophies, coins, power-ups and other items) is saved only on your device.

• If you uninstall the App, clear its data or change phones, your progress and any coins, power-ups and other consumable items are lost and cannot be recovered by us.
• One-time purchases (such as Remove Ads, Maneki Kaiju, the Golden Cabinet and the Baby Kaiju) are tied to your Google Play account and are restored when you reinstall the App and sign in to the same Google account.

5. Advertising

The App is free to play and shows ads served by Google AdMob. How ads use data, and how to change your ad choices, is explained in our Privacy Policy.

6. Privacy

Our Privacy Policy explains what data is collected and how it is used. It forms part of these Terms.

7. Intellectual property

The App and everything in it, including its art, characters, music, sounds, text and code, belong to us or our licensors and are protected by law. Apart from the licence in section 1, these Terms give you no rights in them.

8. Changes and availability

We may update the App, change or remove features, events or offers, or stop offering the App. Some updates may be required to keep playing. We try to keep the App available, but we do not guarantee that it will always be available or free of errors.

9. Liability

The App is provided for entertainment. To the extent the law allows, we are not liable for indirect or consequential loss, or for loss of progress or virtual items caused by uninstalling the App, clearing its data, changing devices, or problems with your device. Nothing in these Terms limits liability that cannot be limited by law, or affects your statutory rights as a consumer.

10. Ending your use

You can stop using the App at any time by uninstalling it. If you seriously break these Terms (for example by cheating with purchases), we may stop supporting your use of the App.

11. Changes to these Terms

We may update these Terms from time to time. Changes are posted on this page with a new “Last updated” date. If you keep using the App after a change, the updated Terms apply.

12. Governing law

These Terms are governed by the laws of Ireland. If you live in another country, you also keep the protection of the mandatory consumer laws of that country, and you may bring a claim in the courts where you live.
